After the Appeals Court Nullified the 2023 Finance bill, Kenya’s Highest Court Reinstated it

In a win for President William Ruto’s administration, Kenya’s Supreme Court reversed an appeals court ruling on Tuesday that declared the 2023 finance law unconstitutional. Following the withdrawal of this year’s finance bill due to huge demonstrations, the government had depended on the 2023 law to continue collecting taxes.

The Supreme Court wrote, “We at this moment set aside the Court of Appeal’s finding declaring the entire Finance Act 2023 unconstitutional.

More than 60 people died in June and July as a result of opposition-led protests and disturbances sparked by the 2023 budget law, which raised top income tax rates, imposed a housing charge, and hiked fuel prices. Ruto responded by withdrawing this year’s bill, postponing the payment from the International Monetary Fund (IMF). According to Ruto, the tax increases are essential for paying for development and paying off Kenya’s debt.

After Kenya complied with the Fund’s standards, the new finance tranche would be reviewed by the IMF’s executive board on Wednesday.The Supreme Court stated, “We hereby set aside the Court of Appeal’s finding declaring the entire Finance Act 2023 unconstitutional
