Sudan Claims the UAE is Complicit in Genocide

Sudan is requesting that the International Court of Justice issue emergency orders, often referred to as provisional measures, which would require the United Arab Emirates to take all necessary steps to stop the massacres and other crimes against the Masalit people that took place during the country’s two-year civil conflict.

In his opening remarks at the Hague tribunal, Acting Justice Minister Muawia Osman stated, “The Rapid Support Force, which is primarily made up of Darfur Arabs, is committing genocide against the Masalit with the assistance and cooperation of the United Arab Emirates.”

Every statement made in court was based on circumstantial evidence and did not satisfy the burden of proof. Following Sudan’s presentation, the UAE government released a statement saying, No reliable evidence was presented to support their claims.

Both Sudan and the United Arab Emirates have ratified the 1948 Genocide Convention. However, legal experts doubt that the case will progress because of the UAE’s reservation to a portion of the treaty.

The ICJ has already stated that this kind of reservation is acceptable and prevents a case from moving on. Melanie O’Brien, an expert on the Genocide Convention and associate professor of international law at the University of Western Australia, told The Associated Press, “It is highly probable that the court will say the same thing in this case, which means that the case will not proceed.
