Congo’s Public Prosecutor Advocates for Revoking the Justice Minister’s Immunity

On Wednesday, the Democratic Republic of Congo’s Appeal Court ordered the removal of Justice Minister Constant Mutamba. It intends to prosecute Mutamba for suspected theft of public funds and requests that the National Assembly allow it to conduct a judicial inquiry into him.

He is accused of embezzling $19 million of the $39 million set aside to build a new jail in Kisangani. The private arrangement for the construction was purportedly awarded outside of the standard processes for governmental contracts.

Mutamba promised transparency in his battle against crime and corruption after being appointed last year, pledging to transform what he termed as a “sick system Following a hearing with prosecutor Firmin Mvonde, the president of the National Assembly stated that it would not interfere with the judiciary’s ability to do its duties.

The Assembly promptly formed a special committee to hear Mvonde and Mutamba’s tale versions. However, the African Association for the Defence of Human Rights advises caution. Mutamba should be punished if he embezzled or tried to embezzle monies.

However, it warned that he should be supported if the claims were “made against him by politicians or judicial operators”. Tensions between Mutamba and the public prosecutor’s office have been boiling for some months.
